The safety of our passengers, drivers, and the public is the highest priority of Peak Family Transport LLC.
Peak Family Transport LLC reserves the right to determine whether a passenger is appropriate for transportation based upon:
- Information provided at the time the transportation is scheduled.
- The passenger’s condition upon arrival for pickup.
- Vehicle capabilities.
- Driver safety.
- Applicable laws and regulations.
- Company policies and procedures.
Transportation may be refused, delayed, discontinued, or cancelled if, in the reasonable judgment of Peak Family Transport LLC or its driver, the passenger:
- Appears to require emergency medical care.
- Requires ambulance transportation or a higher level of medical care.
- Requires continuous medical monitoring during transportation.
- Is medically unstable.
- Is unable to be transported safely using the reserved vehicle.
- Requires lifting, transferring, or medical assistance beyond the scope of Non-Emergency Medical Transportation.
- Presents a significant risk of injury to themselves, the driver, or others.
- Engages in behavior that creates an unsafe transportation environment.
Peak Family Transport LLC drivers are transportation professionals and are not physicians, nurses, emergency medical technicians (EMTs), paramedics, or other licensed healthcare providers. Drivers do not perform medical assessments, diagnose medical conditions, provide medical treatment, administer medications, monitor medical conditions, or determine medical necessity.
Any decision to refuse, delay, or discontinue transportation is made solely for transportation safety and operational purposes and shall not be interpreted as a medical diagnosis, medical opinion, or medical recommendation.
If a passenger appears to require emergency medical attention, Peak Family Transport LLC may immediately contact 911 or local emergency medical services. If emergency responders assume care of the passenger, the transportation service will be considered terminated.
The Booking Customer and passenger acknowledge that Peak Family Transport LLC reserves the sole discretion to determine whether transportation can be provided safely within the scope of Non-Emergency Medical Transportation services.
Refusal or discontinuation of transportation for safety reasons shall not constitute negligence, discrimination, abandonment, or a breach of these Terms of Service.
