Reservation Terms & Conditions

By checking the agreement box and submitting this reservation, you acknowledge that you have read, understood, and agree to these Terms and Conditions.

Reservation Confirmation

All reservations are subject to review and acceptance by Peak Airport & Charter. Once your reservation is accepted, it becomes a confirmed transportation reservation.

Payment Authorization

Payment in full is required at the time of booking to reserve your requested date, time, vehicle, and driver.

By submitting your reservation, you authorize Peak Airport & Charter to charge the full amount of your reservation to the payment method provided.

No reservation is guaranteed until payment has been successfully processed

Non-Refundable Reservation

Peak Airport & Charter reserves a vehicle, driver, scheduling resources, and operating capacity specifically for your reservation. For this reason:

  • Cancellations by the customer are non-refundable.
  • Failure to appear for your scheduled pickup (“No Show”) is non-refundable.
  • Missed flights, changes in travel plans, or changes in personal circumstances do not entitle the customer to a refund.
  • Requests to shorten, modify, or cancel a reservation after confirmation do not create a right to a refund.

If  We Are Unable to Provide Service

If Peak Airport & Charter determines that we are unable to safely or reasonably provide your requested transportation for any reason, or if we decline your reservation before service begins, your payment will be promptly refunded in full to the original payment method.

Examples include, but are not limited to:

  • Vehicle unavailable due to mechanical failure.
  • Unsafe weather or road conditions requiring cancellation.
  • Scheduling conflict discovered after booking.
  • Operational limitations preventing safe completion of the trip.
  • Reservation declined by Peak Airport & Charter
  • Flight Monitoring

For airport transportation, customers are responsible for providing accurate airline and flight information.Peak Airport & Charter monitors commercial flight arrivals and departures and will make reasonable scheduling adjustments for normal airline delays when accurate flight information has been provided.

Passenger Responsibilities

Passengers agree to:

  • Be ready at the scheduled pickup location at the agreed time.
  • Wear seat belts at all times.
  • Treat company vehicles respectfully.
  • Follow all driver instructions.

Passenger Conduct Policy, Prohibited Activities, and Right to Refuse Service

The safety of our passengers, chauffeurs, and the public is our highest priority. Peak Family Transport Airport and Charter reserves the right to refuse, deny, discontinue, or terminate transportation services whenever necessary to protect safety, comply with applicable laws, or enforce these policies.

Passenger Conduct That May Result in Immediate Denial or Termination of Service

Peak Family Transport reserves the right to refuse or immediately terminate transportation services, without refund, for any passenger who:

  • Appears intoxicated or impaired by alcohol or drugs.
  • Consumes or possesses open alcoholic beverages inside a company vehicle.
  • Uses illegal drugs or controlled substances unlawfully.
  • Smokes, vapes, or uses tobacco products inside any company vehicle.
  • Becomes verbally abusive, threatening, intimidating, or harasses a chauffeur or other passengers.
  • Uses profane, discriminatory, racist, sexually inappropriate, or threatening language toward company personnel or passengers.
  • Assaults or attempts to assault another person.
  • Intentionally damages or vandalizes company property.
  • Refuses to wear a seatbelt when required by law.
  • Refuses to follow reasonable safety instructions provided by the chauffeur.
  • Attempts to distract or interfere with the chauffeur while the vehicle is in motion.
  • Attempts to enter or exit the vehicle in an unsafe manner.
  • Carries or uses any firearm or dangerous weapon in violation of applicable law or in a manner that threatens safety.
  • Possesses illegal narcotics, stolen property, or other unlawful items.
  • Engages in criminal activity.
  • Refuses to provide valid identification when requested.
  • Provides false identification or fraudulent reservation information.
  • Allows another person to use a reservation made under a different identity without prior approval.
  • Attempts to transport persons not listed on the reservation without prior authorization.
  • Exceeds the seating capacity of the reserved vehicle.
  • Fails to appropriately secure children in required child restraint systems.
  • Brings an aggressive or uncontrolled animal into the vehicle, except for lawful service animals.
  • Causes excessive soiling of the vehicle, including bodily fluids, food waste, or other contamination.
  • Refuses to pay applicable charges or attempts payment fraud.
  • Initiates fraudulent payment disputes or chargebacks.
  • Engages in any conduct that, in the judgment of Peak Family Transport, creates an unsafe condition or interferes with the safe operation of the vehicle.

High-Risk Activities That Peak Family Transport Does Not Provide

For the safety of our passengers and to maintain compliance with our insurance coverage and regulatory requirements, Peak Family Transport does not provide or participate in the following:

  • Street hails or flag-down service.
  • Taxi service.
  • Ride-sharing or pooled rides unless specifically arranged by Peak Family Transport.
  • On-demand pickups without a confirmed reservation.
  • Transportation arranged through unauthorized third-party applications.
  • Transportation involving open containers of alcohol.
  • Party transportation intended primarily for alcohol consumption.
  • Bar hopping or pub crawl transportation.
  • Marijuana tourism or cannabis-related transportation.
  • Transportation involving illegal drugs or controlled substances used unlawfully.
  • Transportation for unlawful purposes.
  • High-speed driving, racing, or reckless driving upon passenger request.
  • Transport of hazardous materials.
  • Transport of explosives, fireworks, flammable liquids, or hazardous chemicals.
  • Transport of illegal firearms or weapons prohibited by law.
  • Transport of stolen property or contraband.
  • Transport of unrestrained animals, except approved service animals or approved pets disclosed during booking.
  • Transport exceeding vehicle passenger or weight limits.
  • Unauthorized additional stops not approved before or during the reservation.
  • Transportation into areas where access is prohibited, unsafe, or illegal.
  • Transportation that would violate federal, state, or local laws or regulations.

Chauffeur Authority

Peak Family Transport chauffeurs are authorized to refuse, discontinue, or terminate service whenever they reasonably believe that continuing transportation would create a safety risk, violate company policy, violate applicable law, or expose the company or its passengers to unnecessary risk.

Law Enforcement

Peak Family Transport reserves the right to contact law enforcement whenever criminal activity, threats, violence, fraud, or other unlawful conduct is suspected.

Financial Responsibility

If transportation is refused or terminated because of a passenger’s violation of these policies, the reservation shall be considered cancelled by the customer, and all amounts paid shall remain non-refundable. The Booking Customer shall also be responsible for any damages, excessive cleaning fees, towing costs, administrative expenses, or other losses caused by the passenger or members of the traveling party.

Zero-Tolerance Safety Policy

Peak Family Transport maintains a zero-tolerance policy for unsafe, unlawful, abusive, or fraudulent conduct. Our chauffeurs are instructed to prioritize safety above all other considerations and may end a trip immediately whenever necessary to protect passengers, the public, or themselves.

Vehicle Damage and Cleaning

Customers are financially responsible for damage to the vehicle or excessive cleaning resulting from spills, bodily fluids, smoking, vomiting, or other avoidable conditions caused by members of their party.

Delays Beyond Our Control

Peak Airport & Charter is not liable for delays caused by circumstances outside our reasonable control, including but not limited to traffic accidents, road closures, construction, severe weather, airline delays, airport operations, acts of God, government actions, or emergencies.

Limitation of Liability

Peak Airport & Charter’s maximum liability shall not exceed the amount paid for the reservation. We are not responsible for indirect, incidental, or consequential damages, including missed flights, missed appointments, lost business opportunities, or other losses resulting from circumstances beyond our reasonable control.

Lost Property

Passengers are responsible for ensuring they remove all personal belongings before leaving the vehicle. Peak Airport & Charter is not responsible for lost or forgotten property, although reasonable efforts will be made to assist in recovering items.

Right to Refuse Service

Peak Airport & Charter reserves the right to refuse or terminate service when necessary to protect the safety of passengers, drivers, company property, or the public.

Governing Law

These Terms and Conditions shall be governed by the laws of the State of Colorado.

Agreement

By selecting “I Agree” and completing your reservation, you certify that:

  • You have read and understand these Terms and Conditions.
  • You authorize the full charge to your payment method at the time of booking.
  • You understand that confirmed reservations are non-refundable.
  • You understand that if Peak Airport & Charter is unable to provide the reserved service, your payment will be refunded in full to the original payment method.

 

Reservation Ownership and Financial Responsibility

The individual making the reservation (“Booking Customer”) represents and warrants that they are at least eighteen (18) years of age and have the legal authority to enter into this agreement on behalf of themselves and all passengers included in the reservation.

The Booking Customer is solely responsible for:

  • Providing complete and accurate reservation information.
  • Ensuring all minors to be transported have picture ID’s and positive ID matching proof of guardianship or parental authority.
  • If the person completing the reservation is not the guardian or parent of the minor evidence of valid authority to consent to their transport must be submitted to us via portal prior to pick up. Failure to do so will result in reservation cancellation. Examples are birth certificate that matches ID of either parent listed on the birth certificate. Guardianship papers from the courts that establish a clear relationship between the stated guardian and the positive ID of the guardian with the minor being transported along with the guardian or parent signed consent.
  • Ensuring all passengers comply with these Terms and Conditions.
  • Ensuring all passengers arrive at the designated pickup location on time.
  • Providing accurate flight, pickup, and destination information.
  • Obtaining any necessary consent or authorization from the passengers included in the reservation.
  • Payment of all transportation charges, fees, damages, cleaning fees, and any additional charges incurred in connection with the reservation.

The Booking Customer remains financially responsible for the reservation regardless of whether they personally travel with the party.

The Booking Customer agrees to indemnify and hold harmless Peak Airport & Charter from any claims, disputes, chargebacks, losses, or expenses arising from unauthorized bookings, inaccurate passenger information, misrepresentation of authority, or disputes among members of the traveling party regarding the reservation or payment.

By completing the reservation, the Booking Customer certifies that all information submitted is true and accurate and acknowledges that Peak Airport & Charter is relying upon this information in accepting the reservation.

Chargebacks and Payment Disputes

By completing a reservation, the Booking Customer acknowledges that they have read and agreed to these Terms and Conditions and have authorized Peak Airport & Charter to charge the payment method provided for the full amount of the reservation.

The Booking Customer agrees not to initiate a chargeback, payment dispute, or payment reversal for any reservation accepted by Peak Airport & Charter except in the event of actual unauthorized use of the payment method or billing error.

Peak Airport & Charter reserves the right to contest any chargeback or payment dispute by providing supporting documentation, including but not limited to:

  • The completed reservation.
  • Electronic acceptance of these Terms and Conditions.
  • Payment authorization records.
  • Uploaded government-issued identification.
  • Communications by email or text.
  • Driver dispatch records.
  • GPS and trip records.
  • Vehicle location history.
  • Flight monitoring records.
  • Driver notes and photographs when appropriate.

If a chargeback or payment dispute is resolved in favor of Peak Airport & Charter, the Booking Customer remains responsible for all amounts due, together with any reasonable collection costs, administrative expenses, attorney’s fees, court costs, and interest as permitted by applicable law.


Fraud Prevention

Peak Airport & Charter maintains a zero-tolerance policy regarding fraud and identity theft.

Peak Airport & Charter reserves the right to decline, cancel, or delay any reservation when fraud prevention measures cannot be satisfactorily completed or when there is reason to believe the reservation, payment method, or identification is fraudulent or unauthorized.

The Company may request additional verification before accepting or providing service.


Recording and Vehicle Safety

For the safety and security of passengers, drivers, and company property, company vehicles may be equipped with GPS tracking, dash cameras, interior security cameras, telematics systems, and other safety monitoring equipment.

By accepting transportation services, passengers consent to such monitoring to the extent permitted by applicable law.


Force Majeure

Peak Airport & Charter shall not be liable for any delay, interruption, or inability to provide transportation resulting from circumstances beyond its reasonable control, including but not limited to severe weather, road closures, traffic accidents, civil disturbances, airline disruptions, mechanical failures despite reasonable maintenance, natural disasters, acts of government, public emergencies, labor disputes, or other events beyond the Company’s control.

If Peak Airport & Charter determines that transportation cannot be safely provided due to such circumstances before the trip begins, the customer will receive a full refund to the original payment method.


Electronic Agreement

The Booking Customer acknowledges that electronically signing, clicking “Submit Reservation,” or otherwise electronically accepting these Terms constitutes a legally binding electronic signature with the same force and effect as a handwritten signature.


Entire Agreement

These Terms and Conditions constitute the entire agreement between Peak Airport & Charter and the Booking Customer concerning the reservation and transportation services and supersede any prior verbal or written communications relating to the reservation.

If any provision of these Terms is determined to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.


Governing Law and Venue

These Terms and Conditions shall be governed by and construed in accordance with the laws of the State of Colorado.

Any legal action arising out of or relating to these Terms or the transportation services provided by Peak Airport & Charter shall be brought exclusively in the state or federal courts located in El Paso County, Colorado, unless otherwise required by applicable law.


Acceptance of Terms

By submitting electronic payment and submitting a reservation, the Booking Customer certifies that:

  • They are at least eighteen (18) years of age.
  • They have read and understand these Terms and Conditions.
  • They authorize immediate payment in full for the reservation.
  • They understand that confirmed reservations are non-refundable except when Peak Airport & Charter is unable to provide the reserved transportation.
  • They consent to identity verification before transportation.
  • They understand that service may be refused if identification cannot be verified or if any passenger appears intoxicated, impaired, abusive, or poses a safety risk or otherwise violates the aforementioned terms and conditions.
  • They accept financial responsibility for all passengers included in the reservation.
  • In the event that anyone in the party violates the terms and conditions all of the party reservation is terminated.
